The 2nd Offender DUIL Program

If you have been convicted of a 2nd offense OUI in Massachusetts, the Registry will suspended your license for 2 years. If you have refused to submit to a breath or blood test, you will have a 3 year chemical test refusal suspension which will be followed by the 2 year OUI suspension, for a total of a 5 year loss of license.

As part of your second offense OUI sentence, and as a term and condition of probation, you will be required to attend and complete the 14 day in-patient Driving Under the Influence of Liquor (DUIL) program which is located on the grounds of Tewksbury State Hospital in Tewksbury, Massachusetts. Michael Kennedy serves as the program director.

Since your license has been suspended, you cannot drive to the DUIL program. If you drive yourself to the program, your vehicle will be towed at your expense. Also, upon arrival, you will be administered a breathalyzer and a refusal to submit to the  breathalyzer or any positive alcohol readings will prevent you from being admitted to the DUIL program. Since the DUIL program is not a hospital, detox, or medical program, it does not provide medical treatment and you must pass a basic medical screening to be allowed into the 14 day residential program.

As is customary in residential alcohol and other substance abuse programs, your possessions will be thoroughly searched for prohibited items, alcohol, and other contraband.

You are responsible for payment and the Massachusetts DUIL program accepts major credit cards and bank checks. Most health insurances do not cover the DUIL program. You will not receive proof of program completion unless and until your balance is paid in full.

When you complete the Middlesex DUIL Program you will receive proof of program completion and a discharge summary reflecting a high risk of recidivism.  You will not be able to be considered for a hardship license until you complete required aftercare and are issued a new discharge summary, which is based on your completion of both the DUIL program and the required aftercare. This discharge summary is one of the most important documents in any hardship license appeal.
